Komu Terms of Use & Community Rules

Komu is a platform for swapping things locally — no buying, no selling. Members exchange items for points. These Terms govern your use of the service. By creating an account, you accept them.
1. Definitions
- Operator — the provider of Komu: Alicja Filipek, a sole proprietor trading as Alicja Filipek Web Express, NIP 7393680632, REGON 389268422.
- Service — the Komu website and app at komu.co (and related addresses).
- User — a natural person holding an account.
- Points — the internal in-app unit; it is not money or a means of payment and cannot be exchanged for cash.
- Item — a thing offered by a User for exchange.
- Exchange — handing an Item to another User in return for Points.
2. Operator & contact
The Service is operated by Alicja Filipek, a sole proprietor trading as Alicja Filipek Web Express, NIP 7393680632, REGON 389268422.

3. Registration & account
- You must be at least 18 to register.
- Provide accurate details and a secure password. One User may hold one account.
- Your email must be confirmed. You are responsible for keeping your login details confidential.
- Use of the Service is free; you need an internet-connected device and a current browser.
4. Exchanges & Points
- There is no buying or selling — Items are exchanged only for Points.
- Points are not electronic money or a means of payment, have no monetary value, and cannot be withdrawn or converted to cash.
- Points are earned and spent per the Service’s mechanics, which the Operator may define and change.
- An Exchange is an agreement made directly between Users; the Operator is not a party to it.
- Meet-ups and hand-overs happen locally, between Users, at their own responsibility.
5. Prohibited items
It is forbidden to offer, in particular:
- items whose possession or trade is unlawful,
- weapons, ammunition, explosives and pyrotechnics,
- medicines, drugs, alcohol, tobacco and intoxicants,
- counterfeits and goods infringing copyright or trademarks,
- live animals and products of protected species,
- adult, obscene or hateful content,
- other people’s personal data and items hazardous to health.
6. Community rules & safety
- Describe Items truthfully and use your own, real photos.
- Be respectful in messages and at meet-ups; threats, fraud and harassment are forbidden.
- Meet in public places and use common sense and applicable law.
- Do not use the Service for commercial activity, spam, or to game the Points mechanics.
7. User content
By posting photos and descriptions you confirm you hold the rights to them, and you grant the Operator a non-exclusive, royalty-free licence to display them within the Service as needed to run it.
The Operator may remove content that breaches these Terms or the law.
8. AI suggestions
The Service may use AI to suggest a title, description, category or Point value from your photos. For this, photos are sent to our AI provider, Mistral AI. These are suggestions only — you are responsible for the final listing and may edit it freely.
9. Liability
- The Operator provides the Service as a platform connecting Users for exchange.
- The Operator is not a party to any Exchange and is not responsible for the quality, legality, safety or accuracy of Items.
- The Operator strives to keep the Service working but does not guarantee uninterrupted availability.
- Nothing here excludes liability that cannot be excluded under applicable law.
10. Complaints
Complaints about the Service can be sent to alicja.z.filipek@gmail.com. The Operator will respond within 14 days by the same channel.
11. Suspension & deletion
- You may delete your account at any time.
- The Operator may suspend or delete an account for breaches of these Terms or the law, after notice, unless the breach is gross.
12. Personal data (GDPR)
- The data controller is the Operator: Alicja Filipek, contact: alicja.z.filipek@gmail.com.
- We process data to run your account and the Service (Art. 6(1)(b) GDPR) and for legitimate interests such as security (Art. 6(1)(f)).
- Location data is provided voluntarily to indicate an Item’s pickup place.
- We use trusted processors: Cleura (hosting, EU), Mistral AI (photo analysis) and Scaleway (email).
- You have the rights of access, rectification, erasure, restriction, portability and objection, and may lodge a complaint with a supervisory authority.

13. Changes to the Terms
The Operator may change these Terms for valid reasons (e.g. legal or feature changes), giving advance notice. Continued use after changes take effect means acceptance.
14. Governing law & disputes
Matters not covered here are governed by Polish law. Consumers may use out-of-court dispute resolution, including the EU ODR platform (ec.europa.eu/consumers/odr).
15. Final provisions
These Terms apply from the date of publication. If any provision is invalid, the rest remain in force.
